Strasbourg condemns Greece

European Court of Human Rights in Strasbourg has condemned Greece for violation of the right to liberty and security of the two children from Albania and Georgia.

The Albanian minor Albano Bajramaj was arrested in April 2011, when he was only 16 years old, as there were with him a residence permit and held for three days in detention.

While his expulsion from Greece settled without first giving me the right to denounce the lawfulness of his detention and arrest.

After this act of his family to run the Strasbourg Court and that, by accepting the allegations raised condemned forcing Greece to pay the sum of 2,000 euros in moral compensation to the Albanian minors.

In the second case Greece is convicted of violating the third article of the Covenant of Human Rights, under which prohibits cruel and discriminatory treatment, in the case of a child from Georgia, who was abused by the Greek authorities during his detention until was deported.

The minor Georgian had repeated requests to the Greek courts to challenge the continued detention, but, as noted in the Strasbourg decision, they are systematically denied.

Even in this case, the Court of Human Rights, to which the child's family came to protest the conditions of detention, has condemned Greece forcing him to pay 8,000 euros and for moral and material reward.

Greece has been criticized in recent months by the UN regarding the detention process and the dramatic conditions in special centers for thousands of illegal immigrants, especially after an operation to arrest their ongoing since last summer.

Gjykata Europiane për të Drejtat e Njeriut në Strasburg ka dënuar Greqinë për shkelje të së drejtës së lirisë dhe sigurisë ndaj dy fëmijëve nga Shqipëria dhe Gjeorgjia. 

I mituri shqiptar Albano Bajramaj u arrestua në muajin prill të vitit 2011, kur ishte vetëm 16 vjeç, pasi nuk kishte me vete lejen e qëndrimit dhe u mbajt për tre ditë në dhomat e paraburgimit. 

Ndërsa dëbimi i tij nga Greqia u vendos pa iu dhënë më parë e drejta për të denoncuar ligjshmërinë e paraburgimit dhe arrestimit të tij. 

Pas këtij akti familja e tij iu drejtuar Gjykatës së Strasburgut dhe ajo, duke pranuar pretendimet e ngritura, ka dënuar Greqinë duke e detyruar të paguajë edhe shumën prej 2.000 eurosh si shpërblim moral ndaj të miturit shqiptar. 

Në rastin e dytë Greqia është dënuar për shkeljen e nenit të tretë të Paktit të të Drejtave Njerëzore, sipas të cilit ndalohet trajtimi çnjerëzor dhe diskriminues, në rastin e një fëmije nga Gjeorgjia, i cili ishte keqtrajtuar nga autoritetet greke gjatë burgosjes së tij deri sa ishte deportuar. 

I mituri gjeorgjian kishte bërë kërkesa të përsëritura tek gjykatat greke për të kundërshtuar burgimin e mëtejshëm, por, siç theksohet edhe në vendimin e Strasburgut, ato janë refuzuar sistematikisht. 

Edhe në këtë rast, Gjykata e të Drejtave të Njeriut, të cilës iu drejtua familja e fëmijës në shenjë proteste ndaj kushteve të paraburgimit, e ka dënuar Greqinë duke e detyruar atë të paguajë dhe 8.000 euro për shpërblim moral dhe material. 

Greqia është kritikuar në muajt e fundit nga OKB përsa i përket proçesit të paraburgimit dhe kushteve dramatike në qendrat e posaçme për mijëra emigrantë të paligjshëm, sidomos pas një operacioni për arrestimin e tyre që vazhdon që prej verës së kaluar. 

Ndërsa Amnesty International në një raport të fundit të saj ka theksuar se gjendja ka filluar të marrë përmasat e një krize humanitare persa i perket aftesise se organeve greke ne respektimin e te drejtave te azilanteve dhe emigranteve te huaj.
